2. This application under Section 482 Cr.P.C. has been filed

for quashing the proceeding of the Criminal Case No.4033 of

2021; State Vs. Suresh Chandra Sharma, pending in the Court

of Chief Judicial Magistrate, Amroha arising out of Case Crime

No.0577 of 2019, C.N.R. No. UPT3040057242021, under

Sections 3/7 Essential Commodities Act, 1955, Police Station-

Hasanpur, District- Amroha.

3. The sole argument advanced by learned counsel for the

applicant is that since the U.P. Essential Commodities

(Regulation of Sale & Distribution Control) Order, 2016 (here-

in-after referred as the Control Order, 2016) has been issued

under which provision has been made under Section 8(7) that

the competent authority shall take action in respect of violation

of any condition of license including any irregularity committed
