Heard learned counsel for the applicant, Sri Arimardan Yadav,

learned counsel for complainant as well as learned A.G.A for

the State and perused the record.

It is submitted by learned counsel for the applicant that he is

innocent and has been falsely implicated in the present case for

molesting and committing rape with the victim, daughter of the

informant who went to search the lost goat. F.I.R. was lodged

under Section 354-Kha, 323, 506 IPC and Section 7/8 POCSO

Act for molesting the victim. Later on, the case was converted

under Section 376 IPC on the basis of statement made by the

victim which was under pressure of the parents after 12 days of

the alleged incident. Further submitted that allegation is that the

applicant dragged the victim and tore the cloth, in the

meantime, informant reached there then he fled away. Even in
