1. Heard Raj Singh, learned counsel for the appellants, Subhash

Chandra Raghav, learned cousnel for the O.P. No.2 and Munne Lal,

learned A.G.A.

2. This criminal appeal has been preferred against the judgment

and order dated 29.5.2007, passed by learned Additional Session

Judge, Court No.7 Aligarh in S.T. No.780 of 2004, P.S. Khair,

district-Aligarh, convicting the appellants under Section 307 I.P.C.

and sentencing them for three years Rigorous Imprisonment and

imposing fine of worth Rs.5000/- and in case of default both the

appellants have to undergo further additional imprisonment of one

month.

3. In the present case, the prosecution story in brief is that on

4.10.2002 at about 5.30 P.M. complainant Ranveer Singh

alongwith his brother Gyan Singh were ploughing their fields by a

tractor, when the accused Bhura Singh, Karuwa, Suresh, Harkesh
