Heard learned counsel for applicant, learned A.G.A. for the

State and perused the record.

The instant application has been moved on behalf of applicant

with a prayer to enlarge him on bail in Case Crime No.435 of

2014 (S.T. No.1085 of 2014), under Section 302 I.P.C. &

Section 3(2)(v) of SC/ST Act, Police Station Katghar, District

Moradabad, during pendency of the trial.

The brief facts necessary for disposal of this bail application is

that informant Sumit lodged a first information report on the

basis of written tehrir on 6.7.2014 at Police Station Katghar,

District Moradabad in Case Crime No.435 of 2014, alleging

therein that he is the resident of Ambedkar Nagar, Police

Station Katghar, his cousin Pintu son of Gajram forbade Gopal

Saxena son of Itwari, Sonu Sharma son of Indrajeet Sharma and

Mukesh, who is the tenant of Pushpendra not to do the work of

spurious liquor, upon which, on 6.7.2014 at about 08:30 p.m., in
