Counter affidavit filed by the State as well as supplementary

affidavit filed by the applicant are taken on record.

Heard Shri Nanhe Lal Tripathi, learned counsel for the

applicant as well as learned A.G.A. for the State and perused

the record.

Learned counsel for the applicant submits that the applicant has

been falsely implicated in this case and all allegations as

contained in the F.I.R. as well as in the statement of the

informant and other witnesses are false, improbable and could

not be believed.

It is further submitted that the applicant is a respectable citizen

of the locality and he is ready to co-operate in the investigation

as well as in the trial, but the local police is trying hard to arrest

without there being any cogent evidence or material and,

therefore, he be provided protection from arrest in the above-

mentioned case.
