Learned Counsel for the petitioner is permitted to correct the prayer

clause during the course of the day, to bring it in accord with the relief

that is permissible in a petition under Article 227 of the Constitution.

Heard Mr. Dileep Kumar Mishra, learned Counsel for the petitioner

and Mr. S.K. Mishra, learned Counsel for the sole respondent.

The petitioner, who is a tenant in a residential accommodation at

Jhansi, is aggrieved by the order of release of the demised accommodation

under Section 21(1)(a) of the U.P. Urban Buildings (Regulation of Rent,

Letting and Eviction) Act, 1972 (U.P. Act No. 13 of 1972)1 made by the

Authorities below, concurrently.

The petitioner is a second generation tenant. He has inherited the

tenancy from his father, the late Janki Prasad Sharma, in whose favour,

the demised premises were let out. The petitioner shall hereinafter be

referred to as “the tenant”. Jai Prakash Shahu, who is the landlord and
