ALLAHABAD HIGH COURT
MANOJ – Appellant
Versus
SUNIL KUMAR AND ANOTHER – Respondent
A227/1668/2022
Court No. - 6
Case :- MATTERS UNDER ARTICLE 227 No. - 1668 of 2022
Petitioner :- Manoj
Respondent :- Sunil Kumar And Another
Counsel for Petitioner :- Dheeraj Kumar Singh
Hon'ble J.J. Munir,J.
Perused the report dated 19.04.2022 submitted by the Civil
Judge (Senior Division)/F.T.C., Ghaziabad. A perusal of the
report shows that when the suit was at the stage of framing of
the issues, the learned counsel for the plaintiff-petitioner has
chosen to seek leave of the Court to file a replica. Replica is not
a pleading of right and though, the Court has granted
opportunity to the plaintiff-petitioner to file a replica, the
plaintiff-petitioner has disentitled himself to any further relief
by this Court at this stage by way of an order seeking to
expedite proceedings. The learned counsel appearing for the
plaintiff-petitioner has apparently ill-advised the plaintiff to
move the High Court in order to expedite proceedings and then
to come up with a prayer for leave to file a replica.
This Court does not appreciate this kind of a conduct on the part
of the plaintiff or the learned counsel representing him before
the Trial Court.
This petition is dismissed.
Let this order be communicated to the Civil Judge (Senior
Division)/F.T.C., Ghaziabad through the District Judge,
Ghaziabad by the Registrar (Compliance).
