Heard over bail application moved by accused-applicant,

Girish, in Case Crime No. 423 of 2017, under Sections 498A,

323, 304-B IPC and 3/4 Dowry Prohibition Act, Police Station

Jewar, District Gautam Budh Nagar.

Learned counsel for the applicant argued that the accused-

applicant is innocent; he has been falsely implicated in this very

case crime number and is languishing in jail since 31.10.2017;

he is of no criminal antecedent and there is no likelihood of

fleeing from course of justice or tempering with evidence in

case of release on bail; trail could yet not be concluded; it was a

suicide by deceased herself; father-in-law and mother-in-law

have been granted bail. Hence, bail has been prayed for.

Learned AGA has vehemently opposed with this contention that

it was an instant report on the date of occurrence for offence

punishable under Sections 498A, 323, 304-B IPC read with 3/4

Dowry Prohibition Act; an information was given by accused
