Heard learned counsel for the applicant.

This Court vide order dated 22.03.2022 issued notice to

opposite party. As per office report dated 04.05.2022,

undelivered cover has been received with post office

remarks as "Praptkarta diye gaye pate par nahi rehta hai.

Atah wapas."

I have perused the address of the opposite party

mentioned in the plaint as well as notice sent by High

Court. Both are having the same address, therefore, under

such facts of the case, notice is treated to be sufficient and

the Court has proceeded to decide the case on merits.

Learned counsel for the applicant submitted that applicant

is wife of opposite party and residing at Etah alongwith her

parents. He further submitted that opposite party has filed

Matrimonial Case No. 2279 of 2021 (Sudhir Kumar Sharma

Vs. Smt. Somi Sharma), under Section 9 of Hindu Marriage

Act, 1955 before the Principal Judge, Family Court No. 5,

Ghaziabad, which is around 200 kilometers away from
