Heard learned counsel for the petitioner, Sri Ramesh Rai and

Sri Ajeet Yadav, Advocate holding brief of Sri Shivam

Yadav, counsel for the respondent nos. 3, 4 and 5.

Learned counsel for the petitioner has submitted that the

petitioner has been suspended from service by the impugned

order dated 04.03.2022 passed by respondent no. 3, i.e., District

Basic Education Officer, Meerut but the suspension order has

been passed by way of punishment since the order impugned

does not shows that the suspension of the petitioner has been

made in contemplation of any departmental inquiry regarding

charges levelled against her.

Learned counsel for the respondent nos. 3, 4 and 5 has pointed

out to the last paragraph of the impugned order which shows

that any inquiry officer has been appointed to inquire about the

suspension of the petitioner. The impugned order does not

discloses any appointment of Inquiry Officer to conduct inquiry
