Heard Sri Vijay Kumar Rai, learned counsel for the petitioner

and Sri Rajesh Kumar Srivastava, learned counsel for the

contesting respondents.

By means of this petition filed under Article 226 of the

Constitution, the petitioner has challenged the order dated

27.02.2021, whereby, the respondent no. 3 has come to reject

the claim of petitioner for compassionate appointment only on

the ground that the petitioner being married daughter could not

fall within the category of family of the deceased (consisting his

dependents) as per the Dying-in-Harness Rules, 1974 which has

been made applicable to the Corporation.

Learned counsel for the respondents submits that the stand has

been taken to reject the claim of the petitioner only on the

ground that circulars by which Dying-in-Harness Rules, 1974

framed by the State Government has been made applicable to

the Corporation have not been further amended in view of the

judgment
