1. Sri R.C. Yadav, learned counsel for the applicant and Ms.

Alpana Singh, learned AGA for the State.

2. This application U/S 482 has been filed by the applicant

seeking quashing of the impugned order dated 16.02.2021 and

DNA test report dated 07.03.2009 so also order dated

02.03.2021 passed in Sessions Trial No.143 of 2016 (State vs.

Chandan Singh), under Sections 354, 376, 504 and 506 IPC at

Police Station Khaga, District Fatehpur pending before the

court of learned Additional Sessions Judge/FTC, Court No.1,

Fatehpur arising out of Case Crime No.456 of 2015.

3. Learned counsel for the applicant submits that vide order

dated 16.02.2021 an application raising objection on the DNA

report filed on behalf of accused- Chandan Singh was

dismissed. It is submitted that the ground for taking objection is

that the DNA report, as is available on record, is a second copy

and, therefore, that is not admissible in evidence.
