Heard learned counsel for the applicant, learned A.G.A. for the State and

perused the entire record.

The present bail application has been filed by the applicant in Case Crime

No. 165 of 2021, under Section 304 IPC, Police Station - Lodha, District -

Aligarh with the prayer to enlarge the applicant on bail.

At the very outset it is submitted that this is a case of bail parity with co-

accused persons.

On behalf applicant it is submitted by the learned counsel that earlier the

present applicant was granted bail by another coordinate Bench of this

Court, vide order dated 23.03.2022, in Case Crime No. 165 of 2021, under

Sections 272, 273, 307, 420, 467, 468, 471, 120B and 201 IPC and under

Section 60 (A) of the Excise Act, Police Station - Lodha, District - Aligarh

and a copy of his bail order is annexed on page 73 onward to this bail

application.

Later on, since one person in this incident died, Section 304 IPC has been

added to the afores
