Heard Sri Ashish Kumar Gupta, learned counsel for the

petitioner and Sri A.K. Sand, AGA (1st), for the respondents.

The petitioner has filed the instant writ petition praying for a

mandamus commanding the State respondents to release the

petitioner on parole/custody parole for a period of two months,

to enable him to undertake medical treatment and surgery in

relation to various diseases from which he is allegedly

suffering. The petitioner is presently incarcerated in District

Jail, Saharanpur in order to serve life imprisonment awarded to

him in S.T. No. 162 of 2000, arising out of Case Crime No. 177

of 1999, under Section 147, 148, 149, 302 IPC, P.S. Gopiganj,

District Sant Ravidas Nagar (Bhadohi). In the past, by an order

dated 29.1.2020, passed by Supreme Court in Criminal Appeal

No. 196 of 2000, he was granted short term parole in police

custody to enable him to atten
