Counter affidavit filed by the learned A.G.A., is taken on

record.

Heard learned counsel for the applicant, learned A.G.A. for the

State and perused the record.

The present bail application has been filed by the applicant in

case crime No. 793 of 2018, under Section 21/22 NDPS Act,

P.S. Raya, District Mathura with the prayer to enlarge him on

bail.

It has been argued by the learned counsel for the applicant that

applicant is innocent and he has been falsely implicated in this

case. There is no independent witness of alleged recovery of

dizapam. Learned counsel submitted that the first bail

application of applicant was rejected by this Court vide order

dated 13.06.2019, passed in Criminal Misc. Bail Application

No. 14978 of 2019 and after that period of about one and a half

year has passed but not a single witness has been examined so

far. Regarding criminal history of applicant, it was stated that

applicant was on bail in all
