Heard the learned counsel for the petitioner and the learned

Standing Counsel for the State and perused the record.

By means of this petition under Article 226 of the Constitution

of India, the petitioner has sought a restraint on the installation

of Jio Mobile Tower at Mohalla Vijay Nagar, Post Office

Basaratpur, Police Station Chiluatal, District Gorakhpur. A

direction to the respondent no. 2, the District Magistrate,

Gorakhpur to decide the representation dated 17.3.2022 filed by

the petitioner is also sought simultaneously.

The contention of the learned counsel for the petitioner is that

the respondent no. 5 Reliance Jio India is going to install Jio

Mobile Tower in the aforesaid mohalla of the petitioner which

is high densely populated area. The radiation which emits from
