UMESHWAR DEWEDI @ UMESH – Appellant
Versus
State of U.P. AND 2 ORS – Respondent
CRLP 3900/2021

Court No. - 37

Case :- CRIMINAL MISC. WRIT PETITION No. - 3900 of

2021

Petitioner :- Umeshwar Dewedi @ Umesh

Respondent :- State Of U.P. And 2 Ors

Counsel for Petitioner :- Chandra Prakash Misra

Counsel for Respondent :- G.A.

Hon'ble Manoj Kumar Gupta,J.

Hon'ble Gautam Chowdhary,J.

The present writ petition has been filed by the petitioner,

praying for quashing of the First Information Report, registered

as Case Crime No.0054/2021 under Sections 419, 420, 467,

468, 406, 504, 506 IPC Police Station Dohrighat District Mau

with a further prayer to stay his arrest during pendency of

investigation of the said case.

The allegation in the first information report is that the accused

persons have extorted money from the first informant by taking

him in confidence that they would facilitate his visit to

Singapore. In this regard they took huge sum of money on

different dates and brought the petitioner to Delhi for medical

examination to convey an impression that the things are getting

finalized. However, when the informant tried to contact the

accused he found that their mobile phones were switched off.

Later, when the complainant requested the accused persons to

return their money, it was not returned. Instead the informant

was extended life threats.

The submission is that the petitioner has not received any

money and has been falsely implicated.

The submission advanced, does not constitute a sufficient

ground to quash the first information report which clearly

discloses commission of a congizable offence.

Accordingly, the writ petition is dismissed with liberty reserved

in favour of the petitioner to apply for bail/anticipatory bail, if

so advised, and in which event, same shall be considered and

decided expeditiously, without being influenced by the instant

order.
