1. Heard Sri Prabhav Srivastava, learned counsel for the petitioner and Sri

Avdhesh Kumar, learned Standing Counsel for the State.

2. Challenge has been raised to the communication dated 27.11.2018

issued by Assistant Labour Commissioner, Kanpur whereby the said

authority has made the following observations regarding compliance of

award passed in favour of the petitioner.

"Uukt ke sambandh mai apko suchit kia jata hai ki ap award mai diye

gaye nidhnaye ke anusar yadi wadi shramik se kanishth karmchari

karyarat hai to wadi ko bhi karya par lene hetu vichar kare tatha ukt se 15

din ke andar adhyohastakshari ko bhi avgat karaye."

3. In short, the dispute was referred for adjudication, at the instance of the

present petitioner, to the Labour Court Kanpur in Adjudication Case

No.342 of 2006. Thereby the following dispute was referred :

"Kya sevayojakon dwara apne shramik Sri Raj Kumar putra Sri

Dilasharam
