Heard learned counsel for the applicant, learned counsel
for the first informant, learned A.G.A. and perused the
record.
The bail application under Section 439 Cr.P.C. has been
moved by the applicant - Ibne to enlarge him on bail in
Case Crime No. 304 of 2018 under Sections 147, 148, 149,
323, 504, 506, 120B, 302, 341 I.P.C. and 7 C.L.A. Act,
Police Station Shivkuti, District Prayagraj.
It is submitted by the learned counsel for the applicant that
as per FIR general role is assigned to all the accused
persons to assault with lathi, danda and pistol, while no
injury of fire arm was found on the person of the deceased,
though, 15 injuries are found on the person of the
deceased. The cause of death is shock and haemorrhage
due to antemortem injuries. Only injury no. 1, which is on
the skull of the deceased, can be attributed to his death. It
