Heard learned counsel for the applicant and learned AGA for

the State-respondent through vedio conferencing.

Learned counsel for the applicant submitted that he has been

falsely implicated in the present case. He next submitted that

co-accused Chandan Yadav having an identical role has been

enlarged on bail by this Court vide order dated 22.3.2021 in

Criminal Misc. Bail Application No. 13534 of 2021. The case

of applicant stands on similar footing, hence the applicant is

also entitled for bail on the ground of parity. The applicant is

languishing in jail since 26.1.2021 and he has criminal history

of certain cases, which are explained in the affidavit.

Learned AGA for the State has opposed the prayer for bail, but

could not dispute the aforesaid facts.

Considering the material on record as well as the dictum of

Apex Court in the case of Dataram Singh Vs. State of U.P. and

another, reported in (2018) 3 SCC 22, larger
