Heard Sri Yash Pratap Singh, learned counsel for the petitioner

and perused the record.

Present petition under Article 227 of the Constitution of India

has been filed seeking a direction to the Additional Civil

Judge(Senior Division), Court No.13, Allahabad to expedite the

trial of the Succession Misc. Case No. 222 of 2005(Sundari

Devi vs. Rajni Verma and others) within a stipulated time

period.

It is submitted by learned counsel for the petitioner that the

above Succession Misc. Case was filed by the respondent for

issuance of succession certificate on death of her son. It is

further submitted that the petitioner-wife had put in

appearance before the Court below and filed her written

statement and evidence of parties have already been

concluded. It is lastly submitted that on account of delaying

tactics adopted by the plaintiff-respondent, the aforesaid case

could not be decided and is pending since 2005.

Without going
