1.Heard Sri Gaurav Gupta, the learned counsel for the

applicant. Nobody is present for the respondents.

2.By means of the instant application, the applicant is seeking

his release on bail in N.C.B. Case No. 04 of 2020, under

Sections 8/18 Narcotic Drugs and Psychotropic Substances Act,

1985, Police Station N.C.B., Lucknow, District Shahjahanpur.

3.The aforesaid case has been registered on the basis of a

recovery of opium regarding which a search - cum - seizure

memo dated 03/04.03.2020 was prepared, as per which the

officials of Narcotic Control Bureau (hereinafter referred to as

the 'N.C.B.') received a confidential information that a person

named Ashish Kushwaha was coming from Ranchi to Agra

from Begampura Express and he was carrying 03 kg. opium in

a back pack to deliver it to some person at Ambala. A te
