Heard learned counsel for the petitioner, learned counsel for

respondent no.4 and learned AGA for the State.

This habeas corpus writ petition has been filed with a prayer to

direct the respondents to produce Habiba aged about 5 years

daughter of Saadiya Suhani before this Court immediately and

she be handed over to the mother Saadiya Suhani.

Learned counsel for the petitioner submitted that marriage of

Saadiya Suhani solemnized with respondent no.4 Aamir Subhan

r/o Sarguja, Chhattisgarh on 02.02.2007 and two sons, aged

about 13 years and 10 years, and one daughter, Km. Habiba,

aged about 5 years borne out of the wedlock. Saadiya Suhani is

residing in Prayagraj at the residence of his father and

respondent no.4 is residing at District Sarguja in Chhattisgarh.
