Heard learned counsel for the petitioners and learned AGA for

the State.

Learned counsel for the petitioner submits that the applicant is

major as per ration card and radiological report. She has been in

illegal detention in Nari Niketan.

Per contra, learned AGA for the State opposed the contention of

learned counsel for the petitioner and stated that Juvenile Board

has declared the victim as minor aged about 14 years 7 months

and 18 days.

Since the victim is detaining in Nari Niketan vide order dated

4.2.2022, the present petition is not maintenable.

Considering the contention raised by learned counsel for the

parties, the present habeas corpus writ petition is not

maintenable.

Accordingly, the present petition is dismissed with liberty to the

petitioner to challenge the order dated 4.2.2022.
