Heard Sri Mazhar Ullah, learned counsel for the appellant, and learned

Additional Government Advocate for the State respondent.

This Criminal appeal under Section 14-A(1) of Scheduled Castes and

Scheduled Tribes (Prevention of Atrocities) Act, 1989 has been preferred

by the appellant with the prayer to set aside the order dated 07.08.2020

passed by Special Judge, SC/ ST (Prevention of Atrocities) Act/ Additional

Sessions Judge, Rampur in case crime no. 252 of 2020, under section 376

IPC and 3(2) 5 SC/ ST Act, P.S. Shahbad, District Rampur.

As per the allegations in the first information report while daughter of the

informant aged about 16 years was returning home after attending music

ceremony (ladies sangeet) from the house of Arvind on 10.06.2020 that

she was intercepted by the named accused Nazim and he committed sexual

assault upon her.

Learned counsel for the appellant has submitted that while in the statement

under Section 161 Cr.P.C. she did not name of other co-accuse
