Heard learned counsel for the applicant, learned AGA for the

State and perused the record.

It has been argued by learned counsel for the applicant that

applicant is innocent and he has been falsely implicated in this

case. It was stated that applicant was named in the F.I.R. on the

basis of statement of co-accused Ram Prakash Yadav. The

applicant was not apprehended on the spot and that alleged

liquor shop, from which spurious liquor was purchased by the

deceased persons, is of co-accused Ram Prakash Yadav and

applicant has no concern with the said shop. The only allegation

made by co-accused Ram Prakash Yadav against the applicant

is that applicant and co-accused Shiv Sevak Singh used to

cooperate him in the illegal business of spurious liquor. After

three days of incident, applicant was apprehended by the police

and that a false recovery of 9 bottles of spurious country made

liquor
