Kumar, learned counsel for the applicant.

This Court vide order dated 11.08.2021 issued notice to

opposite party. As per o昀케ce report dated 05.10.2021 based

upon postal report, "Item Delivery Con昀椀rmed", but no one

has put in appearance on his behalf. Again this Court vide

order dated 10.11.2021 referred the matter to mediation

centre and as per o昀케ce report dated 12.04.2022 based

upon mediation report, "Mediation completed. No

agreement."

Learned counsel for the applicant submitted that applicant

is wife of opposite party and residing at Jhansi alongwith

her daughter aged about seven years. He further

submitted that opposite party has 昀椀led Case No. 63 of

2020 (Alok Kumar Gautam Vs. Smt. Dipti), under Section 13

of Hindu Marriage Act, 1955 before the Principal Judge,

Family Court, Kanpur Nagar, which is around 220

kilometers away from District Jhansi, therefore, it is very

di昀케cult for the appl
