Learned counsel for parties submits that this writ petition may

be heard finally without exchange of pleadings.

Petitioner is challenging the impugned order dated 7.7.2022

whereby he along with other similarly situated Gram Panchayat

Adhikari are promoted on the post of Assistant Development

Officer and are transferred to different districts.

Learned counsel for the petitioner has vehemently relied upon a

circular dated 20.10.2021, whereby in terms of Clause 5,

petitioner was asked to submit his willingness for promotion

and in case of non-willingness, reasons thereof.

Petitioner has submitted an affidavit in pursuance of the above

clause, showing his unwillingness for promotion along with the

reason thereof being his personal difficulty as well as health

issue of his wife.
