This appeal under Section 58 of Real Estate Regulatory

Authority Act (hereinafter referred as the 'RERA Act') has been

filed challenging the order passed by the Real Estate Appellate

Tribunal (hereinafter referred as the 'Tribunal') dated

04.05.2022 passed in Appeal No. D-814 of 2021 and also

against the judgment and order dated 25.09.2019 passed by the

Presiding Officer, U.P. Real Estate Regulatory Authority,

Regional Office, Gautam Budh Nagar in Complaint No.

1201930276.

The appellant before this Court is development authority which

had undertaken construction of residential flats. The respondent

was allotted flat no. G-11, Airport Enclave, Pocket-B, Meerut

and as the possession of the said flat was not handed over in

time, the respondent moved a complaint before the RERA

Authority. The authority on 25.09.201
