Counsel for the respondents.

The petitioner was appointed as Assistant Teacher in Primary

Section attached with Ashok Vidyapeeth Inter College, Naktaha

Mishr, District Kushi Nagar on 03.07.1980. The Primary

Section of the said college was brought on grant in aid on

01.10.1989 by means of Government Order dated 06.09.1989,

and petitioner, after the college was brought on grant in aid, was

paid salary from the state exchequer.

It appears that pursuant to a Government Order dated

28.01.2004, deduction from the salary of the petitioner for

G.P.F. account was started. The petitioner has retired on

31.03.2020.

After retirement of the petitioner, his pension papers were

forwarded to respondent no.3 for release of retiral dues and

pensionary benefit. The petitioner has been granted retiral dues

excluding the service period prior to 28.01.2004.
