Heard Mr. Ashish Kumar, learned counsel for applicants,

learned A.G.A. for State and Mr. B.D. Mishra, Advocate, who

has put in appearance on behalf of informant/opposite party

no.2 by filing his vakalatnama along with short counter

affidavit in Court today which is taken on record.

This application under Section 482 Cr.P.C. has been filed by

accused-applicants challenging the entire proceedings of Case

No.708 of 2020, (State Vs. Shambhunath Chaudhary and

Another) arising out of Case Crime No.51 of 2019, under

Section 304A of I.P.C., Police Station- Bargadawan, District-

Maharajganj pending in the Court of Chief Judicial Magistrate,

Maharajganj.

Record shows that in respect of an incident which occurred on

20.06.2019, opposite party no.2, Smt. Sumitra Devi lodged a

prompt F.I.R. on 20.06.2019 itself. Same was registered as Case

Crime No.51 of 2019, under Section 304A of I.P.C., Police

Station- Bargadawan
