Heard learned counsel for the applicant, learned A.G.A. for the

State and perused the record.

The only prayer made by the applicant is that a direction be

issued to the court of Additional District Judge, Varanasi to

decide the case in S.T. No.677 of 2002, case crime no.498 of

1999 (State vs. Irshad alias Chachua) under section 302 IPC,

P.S. Cannt. District Varanasi, pending in the court of 6th

Additional District Judge, Varanasi within the stipulated period.

Considering the facts and circumstances of the case and without

expressing any opinion on the merits of the case, this

application under section 482 Cr.P.C. is finally disposed off

with a direction to the court of Additional District Judge,

Varanasi to decide the case in S.T. No.677 of 2002, case crime

no.498 of 1999 (State vs. Irshad alias Chachua) under section

302 IPC, P.S. Cannt. District Varanasi in accordance with law

without granting unnecessary adjournments to either of the

parties as expeditiously as possible preferably within a period

of eight months from the date of production of certified copy of

this order, if there is no legal impediment.
