Heard Mr. Ajay Kumar Singh, the learned counsel for applicant

and the learned A.G.A. for State.

Perused the record.

Applicant is complainant of Complaint Case No. 39 of 2022

(Gurendra Jeet Singh Vs. Harvindar Jeet Singh) under section

138 N.I. Act, P.S.- Milak District- Rampur, who has approached

this court for a direction to Additional Civil Judge

(S.D.)/ACJM, Court No.1, Rampur to decide the

aforementioned Complaint Case.

At the very outset, learned A.G.A. has raised a preliminary

objection by submitting that summoning order has been passed

by Court below only on 5.5.2022. There is nothing on record

tho show that accused has appeared in the complaint case

pending before Court below. On the aforesaid premise, learned

A.G.A. submits that direction as prayed for cannot be granted.

When confronted with above, learned counsel for applicant

could not overcome the same.

Application fails and is liable to be dismissed,

It is accordingly dismissed, at this stage.
