Heard learned counsel for the parties through virtual mode and

perused the record.

The present writ petition has been filed beseeching the

expeditious disposal of Case No. 03629 of 2020 (Triloki Vs.

Pauhari and others) filed under section 176 of UPZA and LR

Act (Now Section 116 of UP Revenue Code, 2006), pending in

the court of Sub-Divisional Officer, Hata, District Kushinagar

(respondent No. 2).

It is submitted that in pursuance of the order dated 2.12.2019

passed by the Additional Commissioner (Judicial) Second,

Gorakhpur, the suit for partition under Section 176 of UP ZA

and LR Act has been remitted before the trial court. Since the

date of remand order dated 2.12.2019, suit for partition, as

mentioned above, is still pending in the court of Sub-Divisional

Officer (respondent No. 2) and no fruitful steps are being taken

by the court concerned to decide it at the earliest. It is further

submitted that parties ap
