This appeal arises out of impugned judgment and order dated

6.5.2008 passed by Additional District & Sessions Judge, Court

No.11, Ghaziabad in Sessions Trial No.1402/2002 (State vs

Ajay alias Kanhaiya Lal & Others) arising out of Crime No.263

of 2000 under Section 302/34 and 201 of IPC, Police Station

Loni, District Ghaziabad, whereby the appellant has been

convicted under Section 302 read with Section 34 of IPC and

sentenced to undergo imprisonment for life, with a fine of

Rs.5000/-, in
