Heard learned counsel for the petitioner, learned standing
counsel representing respondents No. 1, Shri Sunil Kumar
Singh, learned counsel for the Gaon-Sabha(respondent No.2)
and perused the record.
Present writ petition has been filed, inter alia, for the following
prayer:-
"(a) Issue a writ, order or direction in the nature of mandamus
directing the respondent no.1/ Board of Revenue, Circuit Court,
Meerut, Division Meeerut, District Hapur, to decide the IInd
Appeal bearing Case No 1516 of 2021, Old No.21 of 2009,
Computerized Case No. C202111000001516 (Ram Autam Singh
and others Vs. Renu) under Section 331 (3) of the U.P.
Zamindari Abolition and Land Reforms Act, 1950, within
stipulated time."
It is submitted that appeal preferred by the petitioner is pending
since the date of its filing and till date no effort has been made
to decide the aforesaid appeal at an early date. It is also
submitted that due to non-cooperation of the opposite parties,
the matter is not being decided finally.
Learned Standing Counsel as well as learned counsel for the
Gaon-Sabha(respondent No.2) have no objection in case a
direction is issued for early disposal of the case.
In this conspectus, as above, no useful purpose would be served
to keep this matter pending, therefore, this Court deems it
appropriate to finally dispose of the present writ petition,
without making any observation on the merits of the case as
mentioned in the present writ petition, with a direction to Board
of Revenue, Circuit Court, Meerut, Division Meerut,
(respondent No.1), before whom the aforementioned matter is
pending disposal, to decide the same expeditiously, preferably,
within a period of ten months from the date of receipt of a
certified copy of this order.
It is expected that it should be decided by a reasoned and
speaking order, in accordance with law, after affording
opportunity of hearing to the parties concerned without granting
unnecessary adjournments to either of the parties.
With the aforesaid direction, present writ petition is disposed of.
