Heard Sri Hemendra Pratap Singh, learned counsel for the

applicant/appellant and learned A.G.A. for the State and

perused the record.

The instant application under section 389(1) Cr.P.C. has been

preferred with the prayer to suspend the sentence of conviction

and to release the appellant on bail in Session Trial No. 263 of

2002 (State Versus Usman-Ul-Haq), arising out of Case Crime

No. 188 of 2000, under sections 147, 148, 302 read with section

149 I.P.C., Police Station Mainather, District Moradabad,

during the pendency of the criminal appeal.

It is informed that the accused (Munazir) died in jail, whereas,

the other accused have been granted remission by the State

Government.
