Heard learned counsel for the applicant, learned A.G.A. for the

State and perused the entire record.

The instant application under Section 482 Cr.P.C. has been filed

by the applicant for quashing the impugned order dated

07.09.2021 passed by the learned Special Chief Judicial

Magistrate, Kanpur Nagar in Complaint Case No.2048 of 2014

(Sheela Devi vs. Sunita Devi), under Section 138 N.I. Act,

Police Station Bazariya, District Kanpur Nagar.

Learned counsel for the applicant has vehemently submitted

that the cost imposed by the impugned order is unreasonable,

excessive and exorbitant.

His further submission is that the learned trial court while

imposing the cost of Rs.3,000/- while allowing the application

for adjournment moved on the ground of unavailability of

advocate has not considered the matter in its right perspective

which is unsustainable in the eyes of law.
