Heard Sri Kamal Krishna Roy, learned counsel for the petitioners

and Sri Krishna Mohan Asthana, learned Advocate appearing on behalf of

the respondent bank.

The present petition is directed against the recovery citation dated

16.9.2021 issued by the Tehsildar, Dadri, Gautambudhh Nagar pursuant to

the recovery certificate of the respondent bank namely Canara Bank

Branch Bisahada, District Gautambudhh Nagar.

The ground to assail the recovery citation is that the bank has

already approached the Debt Recovery Tribunal by moving application

under the Recovery of Debts Due to Banks and Financial Institutions Act,

1993 and the said original application no.285 of 2021 for recovery of the

outstanding loan is pending before the Tribunal. A notice under Section

19(4) of the Debt Recovery Act, 1993 has been issued to the petitioners

and an application dated 7.9.
