Heard learned counsel for the petitioner and learned AGA.

Present writ petition has been preferred for quashing the FIR dated 13.10.2021

being Case Crime No.361 of 2021 under Section 3/7 Essential Commodities

Act, P.S. Asmauli, Distt. Sambhal and for a direction to respondents not to arrest

the petitioner pursuant to aforesaid FIR.

Present FIR has been challenged on the ground that petitioner is fair price shop

licensee since 1985 and till date there is no complaint against the petitioner

except the present proceeding. At present the petitioner is more than 71 years old

and has no criminal antecedents. The proceeding under the Essential

Commodities Act is already on. License is placed under suspension and the

petitioner has also duly responded with categorical terms. At no point of time he

has distributed lesser quantity of scheduled commodities. It is also submitted
