Heard Sri Harshit Pandey, learned counsel for the appellant and

Sri Gambhir Singh, learned AGA.

This criminal appeal is preferred against the judgment/order

dated 29.04.2017 passed by Additional District and Sessions

Judge Court No. 3, in Special Case No. 570 of 2015 arising out

of Case crime no. 185 of 2015, under Section 377 of IPC and

3/4 PASCO Act, 2012 whereby appellant has been convicted

and sentenced under section 377 IPC to 7 years R.I, fine of Rs.

8,000/- and default sentence of three months.

It is submitted on behalf of the applicant that he has been

sentenced for 7 years for above offences and is languishing in

jail since 29.05.2015, i.e., about 6 years have been served by

him in jail, appeal is not likely to be heard in near future, he be

enlarged on bail.

Learned A.G.A could not demonstrate anything contrary to the

above submission.

Considering the submissions advanced on behalf of both the

sides, I direct the release of appellant Zeeshan on bail during

the pendency of the appeal, on his furnishing a bond with two

sureties of the like amount to the satisfaction of the court

concerned in connection with above noted sessions trial.

On acceptance of bail bonds, the court below shall transmit the

xerox copies thereof to this court for being kept on record.

Release shall be subject to deposit of half fine.

List in ordinary course.
