for the State and perused the record.

This application has been moved with a prayer to release the

applicant on bail during the trial in Case Crime No.605 of 2021,

under Sections 308, 272, 273, IPC and Section 60-A of U.P.

Excise Act P.S.-Tajganj, District-Agra.

It is contended by learned counsel for the applicant that

applicant is innocent and he has been falsely implicated in the

present case due to ulterior motive. He submits that as per the

version of the FIR, noxious liquor is to be administered by

selling out the pouch of liquor to the injured. He next submits

that licensee is Kamlesh Singh and present applicant is nothing

to do with the selling out the liquor. He further submits that

even injured in his statement recorded under Section 161

Cr.P.C. has not stated anything about the present applicant and

has not named him
