The instant revisionist has been filed against the impugned

judgement and orders dated 01.11.2021 and order dated

15.11.2021 passed by learned Additional District and Sessions

Judge, Court No.14, Varanasi in Sessions Trial No.170 of 2021

(State of U.P. vs. Akshay Patel) arising out of Case Crime

No.1549 of 2019, under Section 302 IPC, Police Station Cantt.,

District Varanasi.

Learned counsel for the revisionist has submitted that the

incident took place in a highly crowed area but non of the

prosecution witnesses have been examined by the investigating

officer. According to prosecution case, the alleged incident

committed by revisionist by lathi, danda, but during

investigation, not a single weapon has been recovered by the
