We have heard Shri Prashant Shukla, learned counsel for the

applicant as well as learned A.G.A. for State on the bail

application.

Present bail application has been preferred for a direction to

release the appellant on bail in Special Sessions Trial No.01 of

2010 (State v. Aadesh & Ors.) in Case Crime No.822 of 2009

under Section 302/34 IPC & 3 (2) 5 SC/ST Act & Special

Sessions Trial No.02 of 2010 (State v. Aadesh & Ors.) in Case

Crime No.834 of 2009 under Section 25 Arms Act, P.S. Ghiror,

Distt. Mainpuri.

Learned counsel for the applicant submits that the applicant has

been falsely implicated in the present case. He is languishing in

jail since 29.8.2009 and as per the custody certificate he has

already undergone 14 years 10 months 22 days (with remission)

of sentence. He has no criminal antecede
