1. Heard Sri Sohan Lal Yadav, learned counsel for the

petitioner and learned Standing Counsel for the State.

2. Present petition has been filed by Sri Jai Prakash

claims to be a member of the Committee of Management

of the Institution C.M.L. Inter College, Jani Khurd, Meerut.

He prays for a mandamus upon the District Inspector of

Schools (in short 'DIOS'), Meerut to comply with the

direction issued to that authority by the Joint Director

Education dated 11.09.2019 (annexed as annexure no.3

to the writ petition).

3. Perusal of the aforesaid document reveals that the

Joint Director has written to the DIOS to restrain the

Committee of Management from making any construction

of shops etc.

4. Upon query made, learned counsel for the petitioner

could not point out any provision of law whereunder the

Joint Director or the DIOS may be empowered to restrain

construction of the nature alleged.
