Heard learned counsel for parties.

This petition challenges the orders dated 21 April 2013 and 29

August 2013. By the first order the respondents have proceeded

to impose a minor penalty of fine of Rs.1,000/- upon the

petitioner under the provisions of the U.P. Government

Servant (Discipline and Appeal) Rules, 1999. That order has

been affirmed by the appellate authority. The allegation against

the petitioner was that at the time when the Circle Officer

visited the Police Station where he was posted and asked for the

General Diary, he failed to produce the same. The aforesaid fact

was also noted by the Circle Officer in the Zonal Checking

Register. The petitioner was called upon to show cause. In his

reply, it was contended that the Circle Officer had not come

inside the Police Station and had required the petitioner to

produce the General Diary while he was still standing near his
