Heard Sri Anuruddh Chaturvedi, learned counsel for the

petitioners and Sri Arun Kumar, learned counsel for the

respondents-4, 6, 7, 8 and 9.

The instant writ petition under Article 226 of the Constitution

has been filed challenging the order dated 02.12.2021 passed by

respondent no.1-Board of Revenue, U.P. at Allahabad in

Revision No. 2563 of 2021, whereby revision filed by the

petitioners was dismissed as not maintainable.

With the consent of parties, the writ petition is being decided

finally at the admission stage.

The facts of the case as emerges from the pleading of the

petitioners are that the dispute pertains to plot no. 404 area

0.170 hectare situated at Village Siktaur, Tappa and Pargana

Haveli, Tehsil Sadar, District Gorakhpur. The said land was

recorded in the name of petitioners' ancestors in the basic year

and subsequently, w.e.f. 1374 fasli onwards, the same was

record
