The present petition is claimed to have been filed in public interest, seeking a

direction to the respondents for taking appropriate action against the commercial

activities in the form of pre-primary school in the residential area.

Learned counsel appearing for the respondents have raised preliminary objection

regarding maintainability of the present PIL contending that though the petition

is ostensibly filed in public interest, the petitioner has not made due disclosure

as required by sub-rule (3A) of Rule 1 of Chapter XXII of the Allahabad High

Court Rules, 1952, which was inserted in view of the judgment of the Supreme

Court in State of Uttaranchal v. Balwant Singh Chaufal and others, 2010
