Heard Sri D.P. Singh, learned Senior Advocate for the

petitioners and perused the record.

The plaintiff-respondents, namely, Goddess Durga Virajman

Mandir of Durga Devi Temple through its next freind, instituted

Suit No. 264 of 1988. The suit was instituted by Ex-

Pujari/Sewakar Baba Sri 108 Chetan Das. During the pendency

of the suit Baba Sri 108 Chetan Das, who had instituted the suit

as next friend of the Deity, died. On his death Rajpal Singh was

impleaded as next friend. Later he also died. On his death

Ranvir Singh was impleaded as next friend of the deity.

According to the case of the defendants-petitioners, Ranvir

Singh was removed and in his place District Magistrate, Aligarh

was appointed next friend of the Deity to pursue the suit, who

engaged two lawyers, namely, Sir S.K. Singh, Advocate and Sri

M.K. Saraswat, Advoc
