Heard learned counsel for the applicant and learned A.G.A. for

the State-opposite party.

It is contended that earlier the applicant was released on bail in

the instant case and thereafter he was appearing before the trial

Court on each and every date. However, on account of his non-

appearance before the Court concerned non-bailable warrant

was issued on 07.02.2019. The applicant moved an application

for cancellation of non-bailable warrant but the same was

rejected on 23.09.2021. The applicant is in jail since

23.09.2021. It is next contended that since the trial Court was

not proceeding and the witnesses were not appearing, the

applicant left the district to earn his livelihood, due to which he

could not appear. The criminal history of the applicant has been

explained in Paragraph-4 of the supplementary affidavit. It is

contended that in all the cases the applicant is on bail. Learned
